Our online shop is active and shipments normally depart from Italy (BOLOGNA)

However, possible delays of a few days in deliveries due to the current constantly changing legislative decrees linked to COVID-19 or to disruptions caused by couriers who do not depend on our work.

Orders are processed Monday to Friday from 9:00 to 18:00. They are processed within 48 hours of receipt of the order, and shipped following checks carried out by the company that supervises payments. 

Delivery to ITALY will be made in 3-6 working days (INDICATIVE TIMES) with SDA EXPRESS COURIER

If the UPS courier is not available at this time, an alternative carrier will be used. 

On orders where "collection in store" is foreseen, collection will be available within 3 working days. 

Free shipping in Italy for orders starting from €100.00 (NOT INSURED)

There are no customs fees.

Shipping costs are calculated at check out. 

Free shipping in the Euro area outside national borders for orders starting from €250.00 (insured in case of theft or loss by the courier)

The transport cost for shipments in the Euro area is optional and amounts to: 

Euro 10.00 not insured (value of contents not refundable in case of theft or loss by the courier)

Euro 12.00 insured (value of contents refundable in case of theft or loss by the courier) 

If you choose not to insure the shipment, in the event of theft or loss by the courier you will not be entitled to any electronic voucher or return of the lost goods or refund.

All shipments are DDU (Delivered Duty Unpaid) 

This term means that the seller assumes only responsibility for shipping the product and that, upon delivery, the customer is responsible for paying the shipping carrier any import costs, such as duties, import taxes, or brokerage fees and disbursement

A)

PROCEDURE FOR RETURN OF REPLACEMENT GOODS WITH ELECTRONIC VOUCHER

NYM wants the customer to be satisfied. Therefore, should there be any problems with the order, the customercan return the order within 3 working days from the date of receipt of the orderone or more items purchased and request an exchange of goods or size.
All products purchased on NYM come with an identification tag. We therefore invite the customer to try the product without removing the tag so that it can be returned intact.

NYM S.r.l.s Unipersonale reserves the right to refuse unauthorized or delayed returns.

For products purchased on nym-store.com, the return is the responsibility of the customer.

The cost of the exchange ticket with express voucher is Euro 5.99 for national shipments.

The cost of the exchange ticket with voucher is equal to Euro 15.00 for euro area shipments.

The return in four steps

1) you can proceed directly to the exchange request, from the menu, under returns and exchanges,
request GOODS EXCHANGE

2) You will subsequently receive the return authorization and you will be able to independently proceed with the payment of the shipping ticket,from the menu, under returns and exchanges, pay the ticket after the authorization,.

3) You will receive by email the label to printand put on the package and the courier will come on the day indicated on the label itself in the time slot between 09.00 and 18.30. NYM will directly contact the courier for collection, communicating the customer's address and contact details. (it is not possible to specify collection times by the customer)

4) Upon receipt of the returned product, after the necessary checks, we will issue you a voucher for the same amountto spend for your next purchase without expiration.

 
Method and timing of voucher issuance

The voucher is issued after receipt of the return by our warehouse and after relevant checks.

Verification of product integrity can take up to 5 working days.

Voucher issuing times occur within 3 working days from warehouse confirmation via electronic discount voucher of the same amount to be reused at nym-store.com without expiry

 ATTENTION: once the electronic voucher has been issued it will no longer be possible to request a refund. 

 

B)

PROCEDURE FOR RIGHT OF WITHDRAWAL

In the event of a request to withdraw from the contract you can request the form directly from info@nym-store.com, the entire amount of the order excluding shipping costs will be refunded on the same means of payment within 14 days of delivery of the goods.

The shipping costs are borne by the customer.

Fill out the form attaching a copy of your identity document and the shipping receipt containing the tracking number and forward everything to info@nym-store.com  

Refund times occur within 14 working days from warehouse confirmation using the same payment method with which the order was placed.

NRefunds are not made for small contracts equal to Euro 50.00. 

No refunds will be given for damaged or visibly used goods. 

The customer is responsible for collecting the goods in the event of refusal within 14 working days. 

Terms and conditions of service

Prices

The prices that are guaranteed to the customer are those displayed on the site at the time of the order. However, the latter can be modified at any time in the event of special conditions linked to certain economic factors, rights and taxes, evolution of the cost of labor or raw materials, special customer needs, etc.

All prices are indicated in euros and do not include transport costs which will be automatically calculated and indicated on the order form (cart).

All prices displayed are calculated including value added tax (VAT), which may differ in different billing countries.

Any promotion (discount code, promotion for special occasions, personal voucher) cannot be combined with others in progress. 

Order Fulfillment

1. The trolley constitutes the order form.

2. If you choose to place your order, you must enter the information necessary for billing and delivery of the items. The information that will then be provided commits the customer. In the event of an error in the delivery address header, the site and the company NYM S.r.l.s Unipersonale cannot be held responsible for the impossibility of delivering the item/s.

3. After the validation of the contact details, the means of payment will be chosen. The order will be automatically validated and will constitute an irrevocable commitment on the part of the customer which can only be questioned in the limited cases provided for by these conditions (see the right of withdrawal).

Each order is considered definitive and can only be canceled with the consent of NYM S.r.l.s Unipersonale and this under conditions that will indemnify it for any loss or damage caused by this cancellation.

Order confirmation

At each stage of the order (validation, possible change of availability, shipping) an e-mail is automatically sent provided that the e-mail address indicated in the registration form does not cause errors. The e-mail confirming the processing of the order and the sending of the package will specify the number of the package and the link to the carrier's website for tracking the delivery.

NYM S.r.l.s Unipersonale reserves the right not to confirm an order for any reason (problem relating to the order received or problem with the supply of items). You have 5 working days to indicate to the customer that he cannot fulfill the order and ask him to modify it or otherwise cancel it.

Payment

The total amount is to be paid upon validation of the order. NYM S.r.l.s Unipersonale is not aware of the card numbers and the data is not stored on the server. Access to customers' bank details is not possible either electronically or in print. Payment can be made by the following methods:

1. Credit card (Visa, Master Card, Amex, Maestro, CartaSi, Postepay)

2. Paypal

3. Bank transfer

The order is accounted for upon payment which is irrevocable, in cash, net and without discounts. Any delay, accident or non-payment entails, as a penalty, late interest equal to one and a half times the legal interest rate in application of Italian law.

Delivery areas and terms

COVID-19 EMERGENCY

Our online shop is active and shipments leave normally. However, delays of a few days in deliveries are possible due to the current constantly changing legislative decrees connected to COVID-19 or to disservices caused by couriers who do not depend on our work.

We deliver the items where the customer wants. If you want them delivered to a friend, a neighbor, your workplace... just specify the delivery address, which can be different from the billing address.

Delivery is carried out with the direct delivery of the product to the announced consignee, with, for each delivery, the signature of an acknowledgment of receipt by the identified consignee. In all cases, it is advisable to check the contents and the good condition of the package before signing the delivery receipt.

For any significant delay, we undertake to compensate the customer by offering the delivery costs on his next order. However, exceeding the delivery deadline cannot give rise to compensation for damages, or retention, or cancellation of the order in progress, in the event of total or partial strikes, internal or external to the company, blockade of means of transport or supplies, government or legal restrictions, etc.

NYM S.r.l.s Unipersonale cannot even be held responsible if laws, regulations or any other event lead to a blockage of the articles at the borders.

Right of withdrawal, return and exchange

If for any reason the Customer is not satisfied with the order, or in the unfortunate event that products are delivered that do not comply with the requirements, the Customer has the right to withdraw from the contract without any penalty by following the instructions below:

1. The return can be made within 14 working days from the arrival of the goods

2. NYM S.r.l.s Unipersonale will refund the full cost of the products returned by the Customer, which are deemed unworn, unused and undamaged.

3. In case of return of the product, the latter will be charged to the customer. Similarly, in the event of an exchange of goods, NYM S.r.l.s Unipersonale does not take charge of the transition.

4. The Customer can exercise the right of withdrawal by sending a written communication to NYM S.r.l.s Unipersonale at the e-mail address: info@nym-store.com indicating: Name, Surname, the number of the order for which intends to exercise the right of withdrawal, any motivation 

Dispute

Complaints or disputes will always be received with kindness and attention. In the event of a dispute, the company NYM S.r.l.s Unipersonale will be addressed as a priority to obtain an amicable solution, by post, email or via the contact form in the Contacts section of the NYM S.r.l.s Unipersonale website.

Warranties

In accordance with article 4 of decree n°78-464 of 24 March 1978, the provisions hereof cannot deprive the customer of the legal guarantee which obliges the professional reseller to guarantee him against all the consequences of hidden defects of the thing sold. The company is not the manufacturer of the products presented on the www.nym-store.com website, in accordance with the law n°98-389 of May 19, 1998 relating to liability for defective products.

Consequently, in the event of damage caused to a person or property due to a product defect, only the liability of its manufacturer may be pursued by the Customer, on the basis of the information appearing on the packaging of the aforementioned product. Furthermore, the company reminds that the products, services and information offered by NYM S.r.l.s Unipersonale do not in any way replace the constant supervision of adults.

The responsibility of NYM S.r.l.s Unipersonale could not exist in the event of failure to comply with the legislation of the country in which the products are delivered. It is up to the customer to check with the local authorities the possibilities of importing or using the products or services he plans to order.

All conditions

A change in legislation, regulation or a judicial decision which invalidates one or more clauses of these general conditions of sale would not compromise the validity of these general conditions of sale. Such a change or verification could in no case allow the customer not to comply with these general conditions of sale.

Duration and application

These Conditions apply for the entire duration of the online publication of the services offered by the company NYM S.r.l.s Unipersonale. They can be modified at any time by the latter.

Privacy Policy

Pursuant to art. 13 Legislative Decree 30 June 2003, n. 196 ("Privacy Code"), of the art. 13 of the European Regulation n. 679 of 2016 (the "Privacy Regulation"), as well as the Recommendation n. 2 of 2001 adopted pursuant to art. 29 of Directive no. 95/46/CE, NYM S.r.l.s. Unipersonale intends to inform you and all users and/or visitors of the site www.nym-store.com.com (respectively the "Users" and the "Site"), regarding the use of personal data, log files and cookies collected through the Site itself.

The updated list of designated Data Processors can be provided upon request by interested parties and/or Users. The Data Protection Officer is Shopify INC. designated by us which owns the servers where the data is stored. 

2. Information collected automatically by the Site - Cookies

a) Information collected automatically

Like all websites, our site also makes use of log files, in which information collected in an automated manner is kept during your visits. The computer systems and software procedures used to operate the Site, in fact, automatically acquire certain information during use, the transmission of which is implicit in the use of Internet communication protocols.

The information collected is as follows:

Internet Protocol (IP) address or domain name of the device you are using;
type of browser and parameters of the device used to connect to the Site;
the addresses in URI (Uniform Resource Identifier) ​​notation of the requested resources or the method used in submitting the request to the server;
name of the internet service provider (ISP);
date and time of visit;
web page of origin (referral) and exit of the User;
possibly the number of clicks;
the size of the file obtained in response;
the numerical code indicating the status of the response given by the server (successful, error, etc.);
other parameters relating to the operating system and IT environment of your device.
This information is processed automatically and collected exclusively in aggregate form in order to verify the correct functioning of the Site.

3. The personal data you provide us using the Site: for what purpose we treat them.

Your data is used to allow you, through the use of the Site, to:

a) access the website www.nym-store.com (hereinafter the "Site") and use the following services (the "Site Services") of :

- online purchase, using the electronic commerce platform service (hereinafter "E-commerce"), which allows you, among other things, to have the packages containing the products marketed by the Owner delivered to the address you indicated (hereinafter the "Products");

- update, by e-mail, regarding all our promotional and marketing initiatives, including direct ones, including, by way of example, information regarding the latest collections, events and advertising campaigns organized by the Data Controller (the "Newsletter ”);

Your data is processed for the following purposes:

(i) execute your purchase orders for Products online through the Site, fulfill the related administrative and accounting obligations (e.g. for order fulfillment, correspondence, invoicing) and arrange for the delivery of the same through the platform E-commerce (e.g. delivery and/or collection, any requests for information, complaints, etc.);

(ii) comply with legal obligations;

(iii) carry out the technical management of the Site;

(iv) provide you with the Newsletter service;

(v) analyze your preferences, habits, interests and consumption choices, including the type, frequency, location of purchases, in order to process statistics, create specific user profiles and carry out predictive activities in relation to your future consumption ( hereinafter, the "Profiling Activity");

The processing of data for the aforementioned purposes will be carried out in compliance with the Privacy Code, the Privacy Regulations and all the specific sector regulations including the provisions of the "Guarantor Rules for loyalty programs" of 24 February 2005 and the guide on the processing of personal data for online profiling" of 19 March 2015.

In compliance with the "Guidelines on promotional activity and the fight against spam" of 4 July 2013, we point out that the consent you may have given for the sending of commercial, promotional and marketing communications using automated tools will also extend to traditional methods of contact.

The data you provide will mainly be processed with IT tools under the authority of the Data Controller, by subjects specifically appointed, authorized and trained for processing pursuant to article 30 of the Privacy Code and articles 28 and 29 of the Privacy Regulation . We inform you that suitable security measures are observed also pursuant to articles 5 and 32 of the Privacy Regulation to prevent data loss, illicit or incorrect use and unauthorized access.

4. Mandatory or optional nature of the consent for the provision of data, the consequences of any refusal and the legal basis of the processing

Know that for the purposes referred to in points (i), (ii) and (iii) of the previous art. 3, the provision of your personal data is mandatory as without it you will not be able, through the Site, to use the Site Services offered, including the transport, delivery and/or collection of Products through the E-commerce platform.

Instead, the provision of your personal data is not mandatory but optional for the purposes referred to in points (iv) and (v) of the previous art. 3. Failure to provide data for the purposes just indicated will not allow us to provide you with the Newsletter and to carry out the Profiling Activity. To this end, you can freely decide whether or not to give your consent also for these purposes and without this inhibiting the possibility of accessing the Website Services.

Remember that, in any case and at any time, you can request the Data Controller to delete your data through a simple communication to be sent, without particular formalities, to the addresses referred to in the previous art. 1.

With reference to the purposes referred to in points (i), (ii) and (iii) of the previous art. 3, the legal basis of the processing is in fact the execution of the services provided through the Site and requested by you (pursuant to article 6, paragraph 1, letter b of the Privacy Regulation and article 24, paragraph 1, letter b of the Privacy Code); instead, with reference to the purposes referred to in points (iv) and (vi) of the previous art. 3, the legal basis of the processing is your freely expressed consent (pursuant to article 6, paragraph 1, letter a of the Privacy Regulation and article 23 of the Privacy Code).

5. To whom and in what context we can pass on your data

Your data may be communicated, within the EU, in full compliance with the provisions of the Privacy Code and the Privacy Regulation, to the following subjects:

(i) to the financial administration and/or other public authorities, where this is required by law or at their request;

(ii) to credit institutions for purposes instrumental to the online purchase of the Products;

(iii) to the structures, subjects and external companies that the Data Controller uses to carry out related activities, instrumental or consequent to the execution of the Site Services - including the cloud computing archiving service, transport, delivery and/or withdrawal of the Products through the E-commerce platform - when sending the Newsletter and the Profiling Activity;

(iv) to external consultants (for example, for the management of tax obligations), if not designated in writing as Data Processors.

6. Your rights

Remember that at any time you can exercise the rights referred to in art. 7 of the Privacy Code and pursuant to articles 15, 16, 17, 18, 20 and 21 of the Privacy Regulation, by sending a written communication to the contact details of the Data Controller referred to in the previous art. 1 and, for the effect, obtain:

confirmation of the existence or not of your personal data with indication of the relative origin, verify its accuracy or request its updating, rectification, integration;
access, rectification, deletion of data or limitation of processing;
the cancellation, transformation into anonymous form or blocking of data processed in violation of the law.
You can also object to the processing of data concerning you.

With reference to the Newsletter, we point out that your right to request the termination of the treatment carried out through automated contact methods also extends to the traditional ones. Furthermore, the possibility remains for you to exercise this right only in part, i.e. by requesting the interruption, for example, of the sending of promotional communications made through one or some of the contact tools for which you have given consent.

7. Duration of Treatment

Without prejudice to legal obligations, personal data will be kept for a specific period, based on criteria based on the nature of the services provided.

It should be noted that the data kept for Profiling purposes will be kept for a period not exceeding 36 months respectively from their registration.

8. Security Measures

Through the Site, your data is processed in compliance with the applicable law and using adequate security measures in compliance with the legislation in force, also pursuant to articles 5 and 32 of the Privacy Regulation.

In this regard, we confirm, among other things, the adoption of appropriate security measures aimed at preventing unauthorized access, theft, disclosure, modification or unauthorized destruction of your data.

9. Changes to the Privacy Policy

The Owner reserves the right to make changes to this Privacy Policy. In this case you will be promptly informed, when you use the Site again.
